1. Who you are contracting with

Mellan is made and licensed by Felix Wotschofsky, a sole proprietor registered at Mozartstraße 2, 91207 Lauf an der Pegnitz, Germany (“Mellan”, “we”, “us”). You can reach us at help@mellan.app.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Your purchase is therefore also subject to Paddle’s Buyer Terms.

2. What Mellan is

Mellan is software: a macOS menu bar app and a companion Android app that connect one Mac and one Android phone directly over Bluetooth Low Energy to share a clipboard and related continuity features. It is not a service, it stores nothing on our servers, and it needs no account. Everything it does happens on the two devices you pair.

3. Your licence

When you buy Mellan we grant you a personal, non-exclusive, non-transferable, worldwide licence to install and use Mellan on devices you own or control, for as long as your licence is valid. You may not:

• resell, rent, sublicense or redistribute Mellan or your licence key;
• remove or work around licence checks, or share your licence key;
• reverse engineer Mellan except where that right cannot be excluded by law.

We keep all intellectual property rights in Mellan. Buying a licence buys the right to use the software, not ownership of it.

4. Trial and purchase

Mellan is free to try before you buy. When the trial ends you need a valid licence to keep using the paid features. Prices are shown at checkout in your local currency where available and include any tax Paddle is required to collect.

5. Refunds

Because Mellan can be fully evaluated for free before purchase, our Refund Policy applies to every order. Your statutory rights as a consumer are not affected.

6. Updates and changes

We may update Mellan to fix bugs, keep it working with new versions of macOS and Android, and add features. We may also discontinue features. We will not remotely disable a licence you have paid for, except where required by law or in response to abuse of clause 3.

7. No warranty

Mellan is provided “as is”. We do not warrant that it will be uninterrupted, error free, or compatible with every Mac, phone, Android skin or Bluetooth stack. Bluetooth behaviour varies between manufacturers and is outside our control.

8. Liability

We are liable without limitation for damages caused intentionally or by gross negligence, for injury to life, body or health, and under the German Product Liability Act. For slight negligence we are liable only for breach of a material contractual obligation, and only up to the damage typically foreseeable at the time of contract. All other liability is excluded.

9. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you also keep the protection of the mandatory law of the country you live in.

10. Changes to these terms

We may update these terms for new features or legal reasons. The version published here at the time of your purchase governs that purchase.
